BREMBOPARTS PRIVACY POLICY

Dear User,
On this page you will find information, following the applicable legislation on personal data protection (Regulation (EU) 2016/679 or the "Regulation"), describing how your personal data is managed on the "Bremboparts" website (hereinafter the "Site") and mobile application (hereinafter the "App").

Data Controller and Data Protection Officer
The Data Controller, i.e. the person who makes the decisions concerning the manner and purpose of the personal data processing, is Brembo N.V. (hereinafter "Brembo"), with registered office in Amsterdam, The Netherlands, and its operating and administrative headquarters in Bergamo, via Stezzano 87 - 24126 Bergamo (BG), Italy. The Controller can be reached by telephone on 035 605 2111 or by e-mail at privacy@brembo.com.


The Data Protection Officer, who is in charge of monitoring compliance with the Regulation, can be contacted by writing to privacy@brembo.com or at the address of the Controller's registered office (Via Stezzano 87, 24126 - Bergamo, Italy), FAO the Data Protection Officer.

Information on personal data processing
When you visit, browse or use the services available on this Site and/or the App, we may process the following data relating to persons who are or may be identified according to the legislation in force as set out below.

1. Personal area creation and sending of newsletters.

1.1 Personal data collected

You will be asked for the following data when you sign up for your private area and/or the newsletter: 

  • Login data: email address, country, area of interest, password, or necessary data for authentication via Google or Microsoft accounts should you log on to the restricted access area via Google or Microsoft. Be advised that Google and Microsoft operate as independent data controllers, so users are advised to view the respective privacy policies before logging in, which are available from the following links:
  • Additional data: you may be asked to enter additional data in your personal area, such as first name and surname, address, type of profile (private and/or company) and vehicle data.
     

1.2 Purpose of processing
A) To allow you to create your private account (registration and access to the reserved area) and to take advantage of the services offered (such as, by way of example, so we can provide the assistance requested on our products or allow you to take part in online events and webinars or other reserved Brembo Expert activities);
B) For marketing purposes, to allow us to send you newsletters and commercial and/or promotional information on Brembo products, requests to take part in market research and surveys on customer satisfaction by e-mail.


1.3 Whether provision of data is obligatory or not
The login data requested under A) in the preceding paragraph are necessary to process your request for registration and/or support. Therefore, we will be unable to provide the requested service if you do not provide the required data. The additional data to be entered in the personal area are only required to make use of some functions of the private account and, therefore, their provision is necessary to receive the respective service. 


The personal data requested for the purpose under B) in the preceding paragraph are necessary for you to be able to sign up for the newsletter. Therefore, you will not receive the newsletter and commercial and/or promotional communications if you do not provide the required data.


1.4 Method and place of processing
Processing related to the services of the Site and the App takes place in the European Economic Area.
Personal data are processed mainly by automated means, according to the principles of necessity, lawfulness, fairness, proportionality and transparency for the purposes and in compliance with the principles of lawfulness (legal basis). Specific safety measures are observed to prevent loss of data, illicit or incorrect use and unauthorised accesses.


1.5 Legal basis for data processing

With regard to the purposes connected with the handling of your request and account, the processing is necessary to fulfil pre-contractual measures following your request and executing a contract.
With regard to marketing purposes and the sending of newsletters and promotional and/or commercial messages, the data are only processed if you have given your specific consent (which can be revoked at any time) or have specifically submitted a request using the appropriate request form.


1.6 Data recipients
The data are processed by Brembo personnel authorised to process the data and by its suppliers providing services, such as the technical management of the Site and App and the hosting service, in their capacity as Data Processors. These people act according to instructions from Brembo.

1.7 Data retention
For the time strictly necessary to pursue the stated purposes or to fulfil your request, in compliance with statutory retention obligations. In the case of processing for marketing purposes, the data are retained until consent is revoked and in any case for the maximum period permitted by law or by specific provisions of the supervisory authority.

2. Browsing the Site and using the App


2.1 Personal data collected
The following data will be collected while browsing the Site and/or using the App:
A) IP address and navigation data; 
B) Data relating to the geolocation of your device.

2.2 Purpose of processing

Browsing the Site and using the App. During their normal operation, the computer systems and software procedures used to operate this Site/App acquire some personal data for communication that is implicit in the use of internet communication protocols. This information is not collected for association with identified data subjects, but may by its nature, through processing and association with data held by third parties, permit the identification of users. 
This category of data includes the IP addresses or domain names of the devices of users connecting to the Site and/or using the App. The navigation data are used to obtain anonymous statistical information on the use of the Site and to control its operation; installation of technical/session cookies to improve the functionality of the Site and further cookies as described in the cookie policy, which we invite you to read and which is available at  following link.

 

Geolocation. If you agree to share your location by activating the relevant function on your device, we can help you find the nearest specialised dealer or workshop to your location. 
 


2.3 Whether provision of data is obligatory or facultative
The provision of the personal data required for the purposes under A) in paragraph 2.1 is obligatory because it is necessary to use and access the various functions of the Site and the App. 
The provision of the personal data required for the purposes under B) in paragraph 2.1 is optional: your device's location data will only be collected and processed if you provide your consent using the settings of your device by selecting, according to your preference, to give consent for a single browsing session and/or use of the App ("one time only") or for all subsequent use sessions.

 

2.4 Method and place of processing
Processing related to the services described in this paragraph takes place in the European Economic Area.

On the other hand, the legal basis for the processing of the personal data requested for the purpose under B) in paragraph 2.1 is your consent.

2.6 Data recipients
The data are processed by Brembo personnel authorised to process the data and by its suppliers providing services such as the technical management of the Site and App and the hosting service, in their capacity as Data Processors. These people act according to instructions from Brembo.

2.7 Data retention period
For the duration of the browsing session on the Site and the entire duration of the use of the App.
Brembo also provides a service to Site and App users for identifying the characteristics and specifications of the car (such as pads and brakes, discs and drums, shoes, etc.) and the respective Brembo products that may be used. You are required to enter your licence plate number to use this service. This is needed to acquire (via public registers) the necessary technical data (relating to make, model, engine, years of production) essential for providing you with correct information. The data will only be processed at the same time as your request and will not be stored or subject to further analysis by Brembo, nor will it be associated with your registration data.

Rights of the data subject
You may access your data at any time and free of charge, receive your electronic personal data in a structured and commonly used machine-readable format (right of access) and ask us to pass them on to another Data Controller (data portability) where applicable, as well as have them corrected, updated, amended (right to rectification) or deleted (right to erasure) (subject to any applicable exceptions). Please note that requests for data erasure are subject to existing legal and document retention obligations imposed on us by law or regulations. 
Where the processing of your data is based on consent, you have the right to withdraw your consent, at any time, where applicable (right to withdraw consent). You may at any time decide not to receive any further promotional/marketing communication and thus object to the processing of your data for marketing purposes (right to object).  You may also restrict the processing of your data, or exercise the rights mentioned above, by addressing your request to the Data Protection Officer at privacy@brembo.com, or by mail to Brembo N.V., at the address of the operational and administrative headquarters indicated above, FAO Data Protection Officer.
